Benefits for days of work lost
Since a worker who is ill or injured and receiving treatment cannot work, during the period and cannot receive a salary, he is paid the standard benefit that is equal to 60% of his average daily wage. This benefit begins after a waiting period of three days.
However, in the case of a work accident concerning which no benefit will be paid for three days, the injured worker is compensated for the three days of the waiting period under the Labor Standards Law that states that the worker will receive 60% of his daily salary for the three days.
The Labor Standards Law does not provide compensation for loss of work caused by injuries from accidents occurring while commuting to, or from, work.
-
Limitations on dismissal
The Labor Standards Law states that an employee that has been injured or been made ill in the course of his work and is unable to work because he is receiving medical treatment may not be dismissed from his job until at 30 days after he has recovered. Concerning accidents occurring while commuting to, or from, work, the Law contains no stipulations.
